A
quick summary:
- Yes, development on MLP:Fighting is Magic has stopped for now, per Hasbro's request.
- Yes, we have tried contacting people about the possibility of squirming out from under the C&D, or triumphantly throwing it off as it smashes into a thousand pieces, we ARE still waiting on a couple of replies, but we are not getting our hopes up.
- This post will go over a bunch of questions and opinions we've seen floating around since the announcement.
- We aren't done yet regardless of how this turns out, so please stay tuned :)
Despite
the recent events, what an amazing journey it's been. I wish there
was a less cliche way to say that. What a prodigious peregrination
it's been. (source: thesaurus.com). But it's true. Fueled by nothing
but passion, creativity, teamwork, and all sleeping in the same hotel
bed at least once, our little game has gone from novelty
wouldn't-that-be-cool idea to novelty it-is-actually-pretty-cool
almost (painfully almost) reality. Our site has 7 million+ hits,
that's ~14 million eyes looking at this project. Now, I'm no
mathematician but I think that's over 1.3 billion eyes per second for
the last 2 years.
We
are contractually obliged to acknowledge all of those who supported
the game and believed in it as much as we did, if not more than us,
which is weird (but still appreciated)!
Biggest
thanks to the fans of the game. Without which I truly believe we
would not have come even this far. Seriously, thank you all for
watching our vids, joining our livestreams, reading our site updates,
and looking forward to the game. Thank you for showing your support
through petitions, comments, donations to charity, and of course
HYPE. Also, Don't go anywhere just yet. ;)

Well it legally is fair, and Hasbro can do this, and we have come to the conclusion (with as much advice as we can afford) that it most likely is not going to be contestable in any sort of realistic way.We are doing what we can and still waiting on replies from a few places, but we don't want to provide premature hope just yet. Many of you saw the Ultrachen episode (LINKU) where they talked about our situation, and Ultradavid (probably his real name) who is a real-life lawyer - and also plays one on fighting game streams - covers most of the reasons why it is not viable or advisable for us to pursue aggressively. Our efforts to appeal have been met with either stock standard technically and legally correct responses (that don't differ from the responses that others have received when asking about the game), or silence.
Yes, it's kinda unceremonious that the game can be stopped with the tapping of a lawyer's keyboard, but that is what has happened as of the moment. - It might be a fake C&D!!
We wish it was! Hmm.. Or maybe.. this is all a dream! Although in my dreams I can usually jump really far and float off the ground for a while if I bend my legs really low. All signs point to it being real, unfortunately. - Post the C&D!!
We don't think this would help any, it's really not very interesting, and we don't want to antagonize the situation any more than we have to. - Did you just make up the C&D so you could stop working on it?
No.
And yes, this has actually been asked of us. I know questions can't really be insulting, but this is about as insulting as they can get. I really don't know how to answer this in any more detail without bringing down the tone of this post and increasing it's ESRB rating. I can't even really make fun of it. - Why is this a surprise, you must have known!?
It isn't a surprise! We knew what we were getting into, but we had two choices: continue as if we were going to get squished (ie don't make anything), or continue as if we weren't (ie make the game). There was never going to be a GOOD time for the C&D, but from the complete silence on Hasbro's part up until recently, we were hopeful they would benevolently turn a blind eye for a leeeedle bit longer. Or preferably forever. That wasn't the case. - So move to Antarctica or Sealand or China!
As a method of dodging the C&D we would file this under 'prohibitively unrealistic'. - Should have been more open/closed!
OK. So we'll address both of those (be more secret, be open source). Since we get both criticisms.
Well as they say, “It takes a village to raise a child”, but they also say “A camel is a pony designed by committee.” We were making a pony game, not a camel game! So that idiom has solved the problem for us neatly. Good night.
There was no grand plan for any amount of opennessness or closededaciousness. We started making stuff, we put a vid on youtube, then it blew up (popularity-wise, not Michael Bay-wise) (PS. I wanted to put in a Mission Impossible reference but I was told that not many people would get it), (pps. My bad - Anu). I reckon if we hadn't put that vid on youtube, we would not have gotten as far through the project as we did, at least not to the level of quality it was at.
You guys (the fans) actually DRIVE us to do better. To deliver more. It's not just a coincidence that there are so many personal bests and world records set at the Olympic games. I mean, sure we wanted to make a good game, but once we saw how many people were interested we wanted to make a great one for you. And I think we were succeeding in doing that. I mean if it was totally secret, Hasbro probably wouldn't have seen us until we released a playable version, sure, that's true. I don't think it would have been the game we wanted it to be, or even if we'd bother getting to that stage. I don't know if that fully addresses the “why not secret?” question. But I think it addresses it enough to move on to “why not open?”.
So why not open? Why not make it a community project? Open-source is the best! Hasbro can't take down all of us!

[NOTE: Rewrote this for clarity since the first time was a jumbled stream of consciousness mess that asked far more questions than it answered. SORRY EVERYONE. There is going to be some double up in this section and the next, but that's OK.]
We didn't want it open.
We had no code base. None. There was no code. We still would have not accepted edits into the fightermaker files since they are completely locked and unworkable by two people at once. You cannot merge changes etc.
People have mentioned finding programmers to make a new engine from scratch. We really did not see the point considering we were handed an already proven engine from day one. I mean, it was a pretty rough engine, but we knew it could create a game to a quality we were happy with because we had seen full games created on it.
In terms of modding, the game would have been just as moddable on actual first release as it was during the development process. Fightermaker is out there for anyone to learn about and play with so that when our game did release people would have some idea how to tinker with it.
Given those two facts, the sole reason for having open development would have been to give the public a constant build of the game.
We expected people to trust us to deliver a final finished product. We tried to earn that trust by doing livestreams and site updates. That wasn't enough for some people I guess.A fighting game that is half done, or 80% done, or 90% done, is not a game we'd be proud of. As I've said before, it's a game of direct competition and balance. Once you've got your setting and your fun factor, the only gameplay is balance. It'd be like releasing a chess game with a new rule and a new piece every month.
The leak is out there, people have fun playing it (to a degree, until the infinites and touch of deaths and inconsistent hitboxes and stuff start to become too frustrating). Sure it might have garnered some interest in our game that otherwise wasn't there, but we believe that would have happened on release anyway if people were willing to wait. If it makes people feel any better, and they didn't mind playing a non-finished version of the game, they can just pretend we got C&D'd last july, and the leak was our last public release.We know that fighting games have a lifespan (some ridiculously long, some not), a broken fighting game has almost no chance of lasting too long. If we were going to do this, we were going to do this right.Bottom line:We wanted to be proud of what we produced, and what was out there. We do not feel this makes us selfish or egotistical, but everyone is entitled to their opinion.
If there was any chance that this project was going to make it to the end, we were not going to release a half-finished fighting game.
- Why didn't you just polish up and release a four character beta after the leak? Why not more Betas in general?
Somewhat related to the closed/openicity discussion is the criticism about not doing massive alpha and/or beta releases. I think I've addressed most of our reasons for it in Point A (see above). Also I addressed a lot of that stuff in the post I made after the leak last year. Unfinished fighting games are not fun. Well, at least, they aren't the correct sort of fun. We did need alpha and beta testing, but we needed it tight and controlled. So that's what we did.
The calls for releasing a more stable and balanced and complete four character build after the leak don't really make any sense to us. All we have been doing since the leak is making it more balanced and complete. In fact, making the game more balanced and complete is the definition of the entire development process from start to finish! The leak itself was about as useful as the build a week later, or the week after that, or the week after that. Every iteration was an improvement to balance and gameplay, even to the four characters that were already in there. It was an analog progression. There wasn't any good milestones (except the first release with vs mode and six playable characters that we were working towards, we would count that as a beta) in which a beta would have been useful to us.
You might notice that I said useful to “us”. “What about US?” you might be saying. Referring to yourselves (the community) as “us” not to us (Mane6) as “us”. Of course we know you desperately want to play it, we desperately want you to play it too! Like I've been repeating in different ways, playing it for the sake of playing it is not the same as playing the actual game that was intended. We wanted to make the best first impression we could. Yeah it sounds kinda selfish, but remember we've been working on this thing in our free time for almost two years.Is it any less selfish to demand to play it before it's done? We had to make the decision on your behalf. Was that a bad decision? I dunno, but at least you've heard our reasons for making it, and I hope you can understand where we were coming from. - Why'd you go for the 8th slot at evo with an unfinished game?
We didn't go for EVO! The game was in the running for the 8th slot without our knowledge. It was pushed there by fans! It was your fault!! Nah, it was extremely flattering, and pretty exciting. When we found out that the 8th game was going to be decided by charity drive and realised that the game had already raised some money for breast cancer research, we decided that it was best to go with the flow and see what happened. After they found out that we had not actually put our game in the running ourselves, the EVO team was incredibly supportive and communicative with us during the process, and came up with a pretty neat solution. Of course then Smash bros and Skullgirls kicked our butts! The truth is we didn't know 100% if we would be ready by then. We were 90% sure we would be. We had planned for a late March release of the six main characters in versus mode only (Wow. I think that's the first time we've written a date down in regards to releasing anything. Kinda exhilarating). There would have been a bit of juicyness and polish missing here and there, and surely a few balance issues, but a solid six player fighter would have been out there playing in the long grass. I guess now we'll never know for sure.. aww, I made myself sad. - Why gamespot article?
People ask this question like we spent our advertising budget to get ourselves known. Our advertising budget is about the same as our animator's salary. Which is zero. Before tax. All of the attention we have gotten outside the pony fandom has been completely passive. We put videos on youtube and update our site with little fanfare except in our own twitter, sometimes send a warning to EQD. Nothing outside of the pony fandom has been planned or actively pursued by us. We simply opened our door when people knocked. We never left the house. Some of us maybe even literally.
Gamespot was another of those opportunities. They seemed genuinely interested and Maxwell was awesome to talk to. Also it was worth it for the comments section alone. - What's all this I hear about the 2013 leak?
Easy, there isn't one. The supposed new leaked build is just the old leak with some parts bolted on by someone or someones. Nothing to do with us in the slightest. It is a 'new' build in the same way that I would be wearing 'new' underwear if i stole some from the neighbours dirty laundry pile and wore them. - Are you going to make the game assets publicly available now?
Good question. Very good question. The music is available on RC's youtube and Whitetail's youtube. We are confident that the music is well within the remix and such-and-such guidelines, since they are completely original compositions. The art and animation and other such game assets are a bit trickier, legally, as well as emotionally. As of right now, since you're forcing me to answer in this post that I'm voluntarily writing, I'd have to say “No, not right now”. - Why did your staff members leave if everything's "fine"?
One of the announcements was from Prominence leaving over a year ago, we were just clarifying it in writing in public for the sake of possible legal reasons. We didn't want the possibility of anyone getting in trouble that didn't need to be. Elosande left for similar reasons - of his own accord - more recently, like after we got the C&D.
Rest assured that everyone else working on the game are sticking together.
If
we are certain our project can't continue as originally intended,
we're pleased to say we do have a couple of options for where we can
go next. Whichever option materialises, it will mean a lot more hard
work on our end, and hopefully continued support on your end. It may
also mean that our work on Fighting is Magic was not for nothing.
Well.. we already know it wasn't for nothing, we've forged some
awesome friendships and accomplished a lot, but you know what I mean.
To
answer the question that's probably on a lot of your minds: Yes, it
will have to be a new, original setting. One obvious major benefit to
that is that there will be no more fears of C&D's and such. Of
course, a lot of you are here for the pony aspect. We totally
understand that. We do hope that whatever happens that you will check
in on us from time to time since we're confident we can still give
you guys something fun and exciting.
While
we are still working out the details, we promise we will keep you
posted as things progress and we have more concrete information for
you all.

ReplyDeleteI wish we could at least play with the 6 main characters, and versus mode. I'm not even ashamed to say that I played the leak. And loved it. Loved it so much that I wanted the finished project.
That said... if you guys ever make a game with, say, the Galaxy Girls (from Lauren Faust), I'd probably play the heck out of it, too :D
I really hope this works out for you guys, I check back on this site frequently to see how this is going. I can only hope that you are allowed to continue development, don't give up.

ReplyDeleteI totally respect your awesome work, but even if you do something new it's not going to be the same project that hyped me beyond imagination. I mean, ok, it's cool to see such a good-looking fan fighting game, but Fighting is Magic was more than that, it was also a proof of the love for a show, for its fandom, for everything related to it... I'm afraid I can't just fall in love with something similar but with non-pony OCs, even if those OCs are designed by Lauren Faust U_U

It's a shame the C&D hit so late in the production cycle for the first release. I know I'm not alone when I say I was really hoping we'd make it and was really looking forward to playing the official release. *Sigh.* There's always a silver lining, though, even if Hasbro doesn't relent. However, I had an idea (and I'm probably not the first to bring this up). Do you think Hasbro would be willing to take a one-time licensing fee to allow you guys to keep working on the game? It could be funded through a Kickstarter campaign. I know I'm not alone when I say I'm more than willing to kick in some money if it'll help get this game finished. I and many others are willing to do whatever it takes to see this come to fruition. Regardless of what happens, I look forward to see what you guys come up with in the future. Should it come down to it, would the team change name from Mane Six to something else? Also, would you keep us up to date with those names/other social media sites perhaps? Even though I found you guys through ponies you've amazed me with the work that you've done and I would love to keep following and supporting all of you for the rest of Fighting is Magic and whatever else comes after!

ReplyDeleteYou really misunderstood what free and open source software means. I can assure you that most of software projects would suck due to a lack of direction and a lack of quality control in all the aspects. And free software project somehow works well and can have both of those things - well-defined direction and good quality control.
"Open source" doesn't mean "everyone can contribute without any limitation". It's still up to you if you want to accept contribution or not. It's your project and that's you who decide. The advantage of open projects is that when someone feels that his right is better, and you don't agree with him, then his idea is not lost, cause he can just create a modification.
You can still make a rules about using name of your project, for instance "if you base your game on ours, you have to tell your users" or "if you modify the game, you cannot use our name for your project - we're not associated with it". You can even say "you can do everything, as long as you will keep it open". It's up to you.
You're confusing freedom with anarchy in almost every answer about "why not open source".
It's a shame that everything that happened has happened, and whether or not Fighting is Magic gets a second wind, I'll continue checking up on your guys' work. Can't wait to see your future projects!

Do you think this would be a possible option in the case that you don't come to agreement with Hasbro? Would it work legally to continue development, but only using indirect distribution from person to person, or would it still count as a breach of the C&D?
I completely understand if you don't want to answer this question at the moment if you feel that it might complicate the negotiations.
So what would you say the odds are that you can either come to an agreement with hasbro or find SOME way to move forward (as fighting is magic obviously, not a completely different game)?

ReplyDeleteI don't think you guys have broken the law. It was my initial opinion that the game Fighting is magic was a parody of the television show.

I think this is an accurate description of what you guys were trying to accomplish. It is not illegal to make a parody. However it still can be argued that the game fighting is magic could potentially cause damage to the Hasbro brand. Having not seen the C&D I can only speculate that this is their reasoning.
I don't want to jump to any wild conclusions and paint Hasbro as a villain. They may just be ill-informed. I'd encourage other Bronies to do the same. Try to calm down, hopefully Hasbro will start to understand and lift the C&D.
To the Mane6 team. Don't give up. Getting through is possible and you have our strongest support. Best of luck.

You're right, they aren't the same thing. Open, and open-source. I was grouping them together possibly unfairly, and that was confusing. Most of my criticism was aimed at the openness more than the open-source. I should have probably said community-developed. But I don't want this to be an argument over definition (you're right about that).
ReplyDeleteThe truth is it was never really a serious consideration in the first place. I'm just trying to give a more comprehensive answer and truthfully I probably shouldn't have bothered much more than writing what I just did: we never really considered it. I'll leave the section in the post though.
We used closed-source software, a completely arbitrary and custom animation and importing/palette pipeline, and completely custom 2d sprites. We weren't willing to open up our assets like our sprites simply because we felt they were unique to the game we were creating (and a lot A LOT of work went into the animation and importing process). We wanted the game to be the gift to the community, not the assets.
The alpha got leaked in.. what.. July 2012? The game was essentially open for people to tinker with. Seven months later what has been produced? No new characters, no new moves, nothing that I've seen past a couple of stages, thrown together story modes, flicking a couple of checkboxes in the engine, and some palette swaps. Someone was working on a cool training mode thing but we didn't hear much more about that. People could have downloaded one of the multitude of pony flash models on the net and made up characters and imported them in. I don't think we even once got an email asking for advice on how to use FM2K (fmhq.us is a great start).
Of course, the netcode client was open for anyone to play with, and we asked multiple times, since the engine we used is easily found on the internet for testing out stuff, and people have been improving that side of things pretty consistently.
I truly have no idea where the game would have benefited from opening up any part of the process. I know that open development is a buzzword and sounds romantic but no one has made a convincing argument for it for our project in any way as of yet.
That's true, and that's great for Pony Kart!. But none our engine is not open-source, so since open-sourcing the engine is out of the question, what aspect do you think our game would benefit from being open?

If anything I'm fine with you creating original art or even taking up lauren faust's offer (which would be freakin amazing). All in all, I will continue to watch this project no matter what direction it takes.

I know your arguments for it and I understand them, but they only make quite clear image for me - FM2K is great for you, yes, but not as a tool for making final product - it's great for prototyping purposes. Unfortunately, you insisted on using this prototyping tool for your final product, limiting yourself and your project. You couldn't benefit from open development model, because it's hard to benefit from it when it comes to art, I agree with you. But with this hype and this community you could find amazing team of programmers who would do engine perfectly matching your needs just in time you finished playing with prototypes. In my opinion, you missed perfect opportunity here.

Seriously? Some people are even afraid to admit that they played leaked game, cause they think it's unfair. You haven't permitted us to do anything with leaked game, so you cannot expect good results from that. Are you surprised that in community based on love and tolerance there actually are some people who respect your will regarding game license? That's silly :P
And I think usage of FM2K is another factor. To do anything with your assets one would have to recreate them from scratch, because editing hand-made edited, 256-color indexed sprites would be even bigger pain in the ass than all your fights with FM2K.
And I don't even want to invest time in FM2K, because I know its limitations. 640x480 with 256-colors alone make it out of my interests, and there's more. And I think I'm not alone.
PS. In my opinion, when I base my work on someone else's property, then I at least try to give out everything I made for it. That's also what Double Rainboom project does from the same reasons. Fighting is Magic would be pretty uninteresting and sucking game - it's not due to your assets, music, backgrounds, VAs work and moves. You did amazing work here and it would be amazing gift for community to release that stuff on some permissive license. Without reuse, this fandom wouldn't exist.
Yes, it all sounds romantic, but it really works. And I'm speaking from my own experience.

Well, maybe with all your technical decisions open development model wouldn't really help (I tried to seek the answer to "why?" in my other comment here), but I'm certain it wouldn't hurt either.

I am going to say straight forward, this game was awesome in the orig leak. It would be amazing as a new "leak". Mane 6 should continue a Fighting is Magic game just with OCs. If they decide to not use ponies (no offense) but I see them losing some of their "die hard" fans (not me) and with the possibility of hitting another C&D if they didn't learn from this (which I highly doubt they didn't). Is Hasbro wrong in what they did: no. Should they have done it: I think not. Will I continue to support Mane 6 in the future: heck yeah, no matter what decision they make. Mane 6 is the only Dev team (other than Bungie) that I respect in this day and age. They were on the road to completing the first actual game that has been developed in years. I'm certain that there would have been more playtime put into this game than was put into all the crappy Halo Reach, Halo 4, Black Ops, and Black Ops II all combined (being slightly cocky there). Hope that they decide to stick with the Brony community and not go else where yet, especially since all their hard work would be more easily implemented into another Brony related game.

ReplyDeleteSeeing Derpy in the season finally gives me some hope that Hasbro will do the right thing here for MLP and the community as a whole. I seriously think that this game will bring a lot of people on the fence about MLP into trying out the actual show. I have friends who haven't seen the show but they still want this game. Just think Hasbro, your fandom could increase exponentially with this game! Especially if they could work it out and have it thrown up on X-Box and Steam as an indie game. Here's to hoping.

I'd love to see some of the fandom's OCs in there, like MandoPony, Sethisto, Blob Ponies (all of them can fight at once!), things like that. I think that would be a lot of fun and would offer more of a connection on the part of the creators and fans than all new characters would.

Regardless, its good to hear you guys will keep at it probably, no matter what happens. I hope Hasbro is ok with OC ponies, since Lauren offered and all (which I think was awesome of her). I doubt you will be able to finish this with any canon ponies, but I do hope it gets finished. if it does, I am sure I will give it a try, even of its not my genre. Keep at it guys.

ReplyDeleteEeeyup, I still disagree - what you said with that quote is that "open source" is great for projects which are still finding their direction and have a room for that, and at the same time saying that it's useless for project like yours which doesn't have that possibility (there's also quote from you for that :P). And this is where I think you don't understand - room to grow, direction and quality control has NOTHING TO DO with open development or distribution model. Those are completely not related things which don't influence each other. Actually, it doesn't even influence community driven projects, as there is always someone with power to make final decisions - it's never completely peer-to-peer (look at Wikipedia, for instance).

ReplyDeleteWe talked directly with the guy making the training mode thing for the leak, jumped on a stream session with him to see his work. We aren't that precious that we don't see opportunity for improvement. Kinda lost contact after a while. I think he ended up wanting to spend time with a team "fixing" the leak. Maybe it's even the same guy that's floating around talking about a new engine etc. We'll see I guess.
Also, I've been over MULTIPLE MULTIPLE times why FM2K was a perfectly reasonable choice for our team and project at the time, and why it made far more sense to continue with resources we had. Out of FM2K, MUGEN, or make an engine from scratch, we only had one viable choice given the resources and people we had.

At what stage do you think that would have been a perfect opportunity? And for who? And for what? If your point is that it would have been cool to get a bunch of people working on a fighting engine. Sure. I guess that is pretty cool for the programmers. I'm not sure how it would have benefited us more than having an engine handed to us at minute 0, limitations and all.
We started our project on day one with a basic knowledge of the limitations and format that all our assets would have to be. We also started with zero hype and everyone that was interested in working on the project was in the team. We basically started animating right away. We had already seen FM2K games that worked and had basic story mode and stuff like that. It had already proven itself to be possible. We understand that programmers (such as yourself I assume) like to explore and create and make new things possible.. So do we, but in the art sense. Waiting on a new engine would have been a very staggered start, and we wanted to get started. We didn't have to wait or ask for features in the engine. In a few weeks we had a working alpha with 2 characters performing basic moves against each other, and could start refining timing and hitstuns and all that stuff right away. We used what we had.
Once it became popular we DID have people approach us to make an engine. That was once it became popular, ie, once we had already a huge amount of assets and mechanics specifically designed for FM2K. Needless to say that didn't work out how we wanted, given we stuck with FM2K. We were going fine, the game was feeling how we wanted. Aside from a few annoying things in the engine we can't change, well.. we thought we couldn't change. Read our "thanks to extended team" section carefully ;) we maybe weren't as option starved as you seem to think.
So in essence, the engine already perfectly matched our needs because we adjusted our needs to the engine. At what point would the openly developed engine have caught up to the already made engine? 6 months? a year? 2 years? When would it exceed our current engine? At what point would we be 100% confident that it would do all that Fighter Maker could do with no problems? At what point would completely reimporting all the sprites and mechanics just to test out of the engine worked be worth changing engines?
I can see you are trying to help somehow, but I'm not really getting any new information from this discussion at the moment. We had an engine handed to us that worked, it was never even considered to suddenly ask the community to make us a new engine. You think it would have been amazing, I think it was fine without it. I mean I can tell you are passionate about this, but I still don't understand what you think the major benefit would have been to the game.
The game presumably doesn't make fun of the show enough to count as a parody. It's kind of messed up that critical and humorous usages of copyrighted works are protected and serious fan works aren't, but I guess it does make a weird sort of sense, as it's a lot easier to abuse laws preventing critical speech than it is ones protecting praise.

Thus, Mane6 won't actually host the game - the users will, in their personal computers and servers they may own if they offer to, meaning less/no load on Mane6's servers, faster downloads and possibly no legal risk, if what you say is right.

My sister was going to jump in the MLP fandom bandwagon for this game, I did, most of my friends did, Hasbro just C&Ded a great chance of free advertising aimed at spendrift pony crazed young adults, really I mean, who is going to pay more for a special edition Derpy Hooves figure which looks a lot like the show character, a six year old girl whose pony budget depends on her father or a 20 year old Figting games fan college student (gender irrelevant) whose pony budget depends only on his or her personal effort? realy, Hasbro is throwing away the wrong profit source.

ReplyDeleteWhen the show first came out it was all open and sharing. You could watch the show anywhere and those in charge were basically letting the fans run amok. Now you can call me a cynic, but I am under no delusion that Hasbro's motives were let this get as hyped as possible and get us more attention. Now that the attention level has hit the peak and started back down the other way, I think their trying to plug up everything they see as ever possibly hurting them (like parents thinking Hasbro put out a pony fighting game). Their trying to plug up all the leaks and coast for as long as possible. And if this means turning on the ones that they used to get all the hype in the first place, well I think we all know that when it comes to business most of them are run with a profit over morals mentality. (kinda the opposite from what we try to teach kids with things like MLP)

This has probably already been said before, but you could just call it "fighting is magic", replace all of the delicious mane 6 ponies with plain oc's, and then SOME UNSAVORY CHARACTER from another country might release a mod that changes the oc's to the mane 6.

ReplyDeleteThe key part of being anonymous is that nobody knows who you are. If Hasbro was able to serve them with a C&D they already know their identities.
The only possible way for this to. Work is the same thing that capcom did with megaman X street fighter, make it official. I know it sounds crazy. If you can find a way to get 1million bronies to write their age gender and reason why the game should go official, there's no way Hasbro could turn down this opportunity to gain millions of dollars on a project they haven't invested on. Your game could be sold on Xbox live, pSN, Nintendo store, and steam. Please let the bronies help you, this is your best shot at realizing this game. I know Hasbro said they didn't want a game where there equines beat the stuffing out of each other , but if they can make so much money out of it for free, they can't refuse.

ReplyDeleteConsidering mane6 is operating in their basements, there's no way for Hasbro to stop them finishing the game, just releasing it. So they could just finish the game (with heavy heart), then release it the day Hasbro's MLP trademark is allowed to expire. Which will likely be next century.

I admit I'll be a *little* disappointed if Fighting is Magic never sees the light of day as intended, but I'm sure whatever backup plan you apply yourselves to will come out great. Especially if you team up with Lauren Faust (I'm sure that'd be an incredible experience for you all as well).

Well that's the rub, we aren't owed anything just as the ManeSix was never obligated to make something for everyone.
ReplyDeleteIt's a shame we can't play it, but just handing it out could place them in hot water we don't know about. C&Ds usually extend to the active distribution of said products too, not just development.
Just replace the main 6 with an original characters and give them their move sets.

But given the Non-profit fan production status of the game, wouldn't this mean Hasbro really doesn't have a case against you guys? You're fans making something for other fans with no intent to make any money off of it. plus there's little chance that ((in my opinion) this could pro,mote violence given how it'sprobably going to only be played by the Highschooler to college age set. Anyhow just my thoughts.

ReplyDeleteMajor benefit? Visuals. Sorry to tell that, but FiM feels like a game from early 2000. It's still fun to watch and play (at least that's what I can tell from the leak) thanks to amazing artistic and concept work you all made, but there is lot of wasted potential.
ReplyDeleteThere would be also lots of other benefits, and I think you perfectly know them, but you're trying to hide them, just to justify amount of work you all did to workaround lack of them. At least, that's how it looks from outside.
Well, I don't try to convince you to anything, choosing the engine was already thing of the past even without that bloody C&D letter. But I think I have some valid point which you should at least try to consider (maybe for your future projects?), and I think you missed it from my last comment.
Choosing FM2K was perfect choice for you for all reasons you described, I agree. But it still fits perfectly in what I was talking about - it all matches to prototype, not final product. Creating basic moves for FM2K, trying if your ideas even make sense using this "engine" was the best choice you could made - waiting for programmers to just test your ideas would be stupid. But for me fighting with adjusting FM2K, creating hand-made graphics just to make it look acceptable, researching how to made repaints look good etc. was a waste of time which could be invested much better. Development could go in parallel - artistic prototype in FM2K, without all this palette adjusting stuff and fighting with limitations; and proper game engine. I'm confident that with good team of two-three programmers you could have immediately started using your results from FM2K prototype in an engine made from scratch by them. Making basic things work is a matter of days, maybe few weeks. More advanced stuff could have been added on demand, when needed. That's how making games in fact works everywhere - in big, professional companies and also in small, open communities.
Don't get me wrong, FiM would still be an amazing game. I really enjoyed leaked version and couldn't wait for final release. It just feels really wrong to me that you adjusted your needs to engine - you shouldn't adjust your ideas to tools. You should adjust tools to your ideas.
And I don't believe that deeply inside you wouldn't want to see all assets you made for Fighting is Magic in good-looking, HD-ready engine, with professionally integrated menus for multiplayer and maybe some web based features. All those things were really achievable in my opinion in this amount of time, and game could even be trully multiplatform as a bonus! Ideas are endless, don't let your tools dumb them down next time :)

ReplyDeleteIt definitely would take a ton more research. The tricky part is that this has to be something the ManeSix and Hasbro work on together. A license would mean Hasbro endorses this product and it conforms to their brand of quality control, whatever it may be. It could be loose, it could be strict. I know the ManeSix wouldn't give up creative control that easily. And who knows, maybe Hasbro would loosen the reigns and let them develop of their own accord. All scenarios are possible.
It could be that Hasbro doesn't agree to a license at all due to the game going against the brand's image (which when thinking about the minor violence in the show and the comics endorsed, this stuff is kinda light fare so outright refusal for some minor cartoon game violence would be silly).
The fact is, both Hasbro and the ManeSix have to work this out first. Raising money for a kickstarter would be noble, and I'd totally donate too, but starting it blindly doesn't do any good if Hasbro doesn't agree to a license.
It's a lovely idea, that's something we'll have to ask Nappy :)

I, like everyone else here, was looking forward very much to this game coming out- for both aspects- I'm a big fighting game fan, and a pony fighting game seemed hilariously great. Plus, I mean, who doesn't wonder who would beat who in a fight (hey, if comic fans can argue about that stuff, why can't we???)? Sadly, it looks like that won't happen- unless of course there's the "leak" or "hack" scenario, and I suspect you guys are above giving Hasbro the finger that way. Which is a shame. That, and obviously it's a big risk.
ReplyDeleteAs I said when I heard about this, I've decided not to purchase anything put out by Hasbro or any of the companies they own as a result of this, and I've let them know exactly why I can no longer support their company. Being legally in the right and being morally in the right are different things, and I don't believe their actions are that of a company I can in good conscience support. As has been pointed out all over the place, there were many options other than just killing the game, as well as destroying 2 years of hard work from some of their dedicated fans.
What I find infuriating is all the misinformation spread about how Hasbro has/had no choice, closely followed by people praising them lavishly for how they continue to allow us, mere fans, to exist and have websites, videos, etc.- even as they continue to crack down on projects. The fact is, we don't owe Hasbro a damn thing- they owe US. That isn't entitlement, it's simple math. How much money have you sent their way? We're the paying customers. I've heard it said that attacking Hasbro is "biting the hand that feeds us," but we aren't doing that- THEY are. Hasbro DID have a choice in this, and they chose to go against the fans and community. They will side with the community only for the sake of profit, it's always been simple- the videos of the show were allowed to stay up because they were free advertising. Hasbro is not run by Princess Celestia. They're not trying to promote values through the show. The show is good in SPITE of them, if anything, as I think may be evidenced by their seeming desire to interfere with the show's direction for product reasons. To them, the show is what it's always been- a marketing vehicle. They are not on your side, and never have been. Anyone that thinks otherwise is deluding themselves, and this is the rude awakening they were setting themselves up for. I'm just sick to death of the subservient worship of Hasbro. They're just a company like any other. The cast and crew of the show deserve any and all credit for what it is- Hasbro just rebooted it to sell toys.
Sorry for the rant. Bottom line: I wish you guys the best and I hope that somehow we get to experience what you've worked so hard on all this time. And in this era of hacking attacks and leaks, who says we can't? Not that I'd ever wish for anyone to hack a computer that just happened to have the finished build of the game on it that was made for private use, mind you. That would be tragic.

ReplyDeleteYou've got the right idea. They only care about us for our wallets. Of course, the best way to get to our wallets is by keeping us happy, so sometimes our interests and theirs will overlap, but they don't really care about that. Thinking otherwise is a serious mistake that much of the fandom makes, that sets projects up for disaster and fans up for disappointment. I hope people learn from this, but most people are just jumping on the "Hasbro was only doing what they had to" bandwagon (which is false), and some going so far as to attack Mane6 for working on it and shouting down or dismissing anyone upset about the situation.
ReplyDeleteMe, I can't even think about buying anything pony related- anything official, that is- without being disgusted. I don't like feeling used, and I feel like this was overall an eye-opening experience.
Just a small one, but if it turns out hasbro refuses to remove the C&d (knock on wood) will you still hold onto the original game with the animations and everything? It'd would be a shame to work so hard and all that just end up deleting it all.

Say... assuming that circumstances unfold so that you decide to continue the project within a new, original setting, would you be interested in accepting some fresh faces? Because although I'm not really a programmer, I'd love to lend a hand in the story-writing aspect of production, and I'm sure that there are a bunch of better writers than I who would be equally interested.

It's a difficult situation for Hasbro. Fighting is Magic could potentially damage the Hasbro brand. The C&D letter was a response that protects their image. Don't get me wrong I'm as pissed as everybody else. But when you try to see it from their point of view it really isn't that surprising what they did.
ReplyDeleteWell of course we'd have loved a much prettier game! I do not however believe that that was achievable in the same amount of hours we spent on it. The perfect is the enemy of the good. This was not a job, remember. When we say almost two years on the game, that's just time that has passed since the start of the project, not how many hours we've spent on it (at least for most of our team :) ). If this was 6 people's full-time job for two years, then maybe. Do you know how long the Skullgirl engine was in development? It took 10 years of working on it part time as a personal project. For all intents and purposes this was a personal project that became public very quickly and powerfully. But our resources remained the same.
ReplyDeleteAlso, as much as you will disagree, limitations are a quick route to artificially focus your energies and your team. If our options were unlimited, I believe there is a danger we would have been paralysed by choice. Any time something really open came up, it sometimes took a long time to decide on the best direction, because a lot of this is new to us. This may not be true for all teams and projects, but I think it was true for us. Having unlimited choice is not an objectively positive thing. Scope creep is SUPER dangerous in small projects with no budget or deadline.
I really think seeing the cease and desist could be a good thing. That would let everyone here know exactly what things you can't do.

ReplyDeleteYou know what? Here's my personal head canon of what's going on at Hasbro right now, regardless of any realities that may or may not exist regarding the situation.
ReplyDeleteThe reason they have been so quiet is to not get your hopes up. If they were going to be insistent you not continue, they would have responded to your inquiry with a careful, considered, non-pre-written letter better explaining the situation and their reasons in easier to understand language, like they did when they shut down "Shards of Equestria." I take the silence as evidence that they too would like to let development continue, they saw how close you guys were getting to a real release, and they had to put a halt to it before anything got out that they couldn't properly vet and might potentially damage their brand and legal obligations. They put a halt to it to give them the opportunity to explore every possible option (both under the letter of the law and under the scrutiny of corporate executives and share holders) they might have at their disposal that could potentially allow them to give you guys permission to continue legally. If they can find a way to make it happen, they'll do it. It might even come down to figuring out a way to distribute the game commercially, i.e. securing the rights to use the FM2K engine in a commercial game, or securing the rights to another engine, or even finding a way to port it somehow into something that can be more widely distributed than a Windows-only FM2K game.
That's my head canon. They saw the potential for this to be big and they want it to happen, but they need time to figure out how they can let you do it first.
OC just means "original character." It doesn't necessarily imply that they must be ponies. And they would not.

Like I said "the game could potentially damage the Hasbro brand." If that is the argument Hasbro is trying to make than yes you are correct in saying it is a case of trademark law. I haven't had a chance to read to C&D letter so I don't know 100%.
ReplyDeleteI'm an Illustration student so I have a basic understanding of copyright. I felt I could offer up my opinion and say that there is still an argument that can be made in favour of Mane 6.
If you'd like to share your understanding of how Mane 6 have breach trademark I'd like to hear it.
Because the Chinese tends to ignore U.S. copyright, trademark, and patent laws whenever they find it convenient. It's much harder to fight it internationally when the two different legal systems don't exactly mesh together very well.

ReplyDeleteAdmittedly I got into it because of ponies, but I'm imagining the game sans ponies and I still would want to play it, it look that good. So whatever project the team does come out with, I'm looking forward to seeing.

ReplyDeleteOn top of having done the ultimate favor of restoring a long dead franchise, one that is inherently Hasbro's, it should be noted that you shouldn't praise Hasbro for anything other then being smart enough to throw more money at FiM.
Hasbro will continue to throw whatever their partners want to advertise. It's DHX and Daniel Ingram, and all the beautiful voice talents and story boarders and writers, etc. that MAKE FiM what it is we know and love.
DHX works with our fandom to try and imploy on our behalf ways to acknowledge us and treat us to a good fun time with what they have to work with. It wasn't Megan that wanted Twilight to be a Princess so soon, that was Hasbro toyline.
Be proud to have the staff we have at DHX and all that work on teh show. Be brony because of THEM and not because of HASBRO. Hasbro is merely lucky they can sit back and enjoy the success others create FOR them. Hasbro doesn't what's on the show, they sell toys.
They had Lauren Faust and her hand picked team that became known as DHX from the once Studio B, who made us fall in love with the show.
In short, YOU OWE HASBRO NOTHING!
They don't even release sales figures because we're 80+% of who buys FiM merch and toys. In the end, they only hurt their image more and more.
Brony on because you love the show. Buy toys if you want to support Hasbro. But don't feel you owe Hasbro anything!
